Terms of Service
Job Application Service.

Definitions
- The Company - Careerist Inc. - the owner of the Service.
- Service - the service that finds suitable vacancies for the client and submits applications on behalf of the client on job boards and companies on the territory of the USA.
- Client - any user registered on the Service site.
- Offer - an offer to conclude a contract.
- Career Coach – a Job Search assistant.
- Acceptance - agreement with the terms and conditions and confirmation of the contract.

This document is a public offer of Careerist Inc., a company having its registered office at 680 S Cache Street, Suite 100-8790 Jackson, WY 83001.
A. Subject.
- The Company offers a service that finds suitable vacancies for the Client and submits applications on behalf of the Client on job boards (Glassdoor, Indeed, Monster, and ZipRecruiter) and companies in the territory of the US.
- The Offer includes at least 10 applications per business day (from Monday to Friday) for a subscription period of 30 days.
- The exact number of applications depends on the Client's location and his or her willingness to relocate and is defined with the Client’s Job Search assistant.
- The result of the Service is a list of processed vacancies and calls from recruiters interested in the applicant.
- The Service stops applying for the Client if he or she receives an offer from a company and starts working. At this point the service of the job application will be considered completed.
B. Cost of services and payment procedure.
- The cost of the Service is calculated according to the monthly fee payment plan selected.
C. Refund cancellation policy
- The Client who paid a monthly subscription to the Job Application Service is entitled to a full refund before the Service has started to perform its task.
- If the Service has started to perform its task and started to submit applications for the Client on job boards and company websites, then the Service does not refund the payment.
- If the customer has paid for several months of subscription to the Service and has canceled the subscription after 15 days the Service returns the money for the next months of unused subscription, the money for the current subscription period is not refunded.
- The Client who provides a written notice of cancellation describing the claim within 15 days of signing this Offer shall be entitled to a full refund.
- If the Client needs to leave the Service during the first 15 days due to health issues, medical emergencies, or death of an immediate family member such as parents, siblings, or children, a refund of the unused portion of tuition paid by the client shall be issued.
- All refunds shall be processed within 30 days of the withdrawal request date.
D. Effective date and terms of use.
- This Offer is valid until changes in the present Public Offer are made.
- The Client shall be notified of changes in the Offer one month prior to the effective date of the new version of the document.
- The Client confirms that he or she has read and fully agreed with the Offer when he or she puts "I agree with the terms of the offer" in the web form during order placement.
- The payment for the Service is considered Acceptance of the Service.
- Once the Client begins his or her job search using the Service, he or she can see a list of submissions on the LMS in the JAS section, which includes a list of jobs for which applications have been submitted.
- The Company can change the terms of use of the Service. Clients will be notified of the changes by email, specified during registration, 15 days before the changes take effect.
E. Obligations of the Parties.
- The Company undertakes to organize and ensure the proper provision of services.
- The Service will apply for you not only for those positions that suit you based on your resume, but also for jobs that may be slightly above or below your desired position.
- By interviewing for these positions you can increase your interviewing skills. It is up to you to decide whether or not the position and the conditions of the interview are right for you.
- By using the Job Application Service, you represent and warrant that:
- All questionnaire information you submit will be true, accurate, current, and complete;
- You will maintain the accuracy of such information and promptly UPDATE such registration information as necessary;
- You will register on job boards and provide access to job boards so that the Service can carry out its activities;
- If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
- You must turn off the voicemail feature on your phone to be able to answer the recruiters' calls.
F. Dispute resolution procedure.
- To resolve disputes, the client should send a free-form appeal to the address ([email protected])
- If the problem cannot be resolved amicably, the Parties’ disputes shall be submitted to any state court or federal court located in the states of Delaware or Florida pursuant to current law of the United States of America and by the laws of the state of Delaware.
G. Limitation of liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the service, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising. Certain us state laws and international laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.
H. Personal data.
- The Company asks for personal data through the questionnaire, which is necessary to fill out company forms and job-board postings.
- We do not use clients’ data for other purposes, and we do not transfer it to third parties.
