These Terms of Service (“Terms”) govern your access to internship projects and use of the career coaching services (“Service”) provided by Careerist Inc (“Careerist”, “Company”). By purchasing the Services, you (“Student”, “student”, “you”, “participant”) agree to be bound by these Terms and you confirm that you (a) are above the age of 18 (except if you reside in the state of Alabama or Nebraska you must be 19 years old or older, and you must be 21 years old or older if you reside in Mississippi), and (b) have accepted Careerist Inc. PRIVACY POLICY and Careerist Inc. website TERMS AND CONDITIONS as an integral part of these Terms. If you do not agree to these Terms, please do not use the Service.
2.1. Internship Project
Internship Project offers the opportunity to gain beneficial practical experience by participating in internal and external projects, including completing tasks provided by Careerist´s partner company.
The internship is for students’ educational benefit. The internship is unpaid, indicating neither the Careerist nor the partner company provides financial compensation to students participants of the internship. Internship does not involve the formal employment of the student by the Careerist or Careerist´s partner company.
The duration of the internship project is limited to the period in which the internship provides the students with beneficial learning and in no case shall exceed six months. The internship shall not exceed twenty (20) hours per week.
By accepting the participation in the internship program, Student acknowledges and understands that the internship is a training and educational experience for which the Student will not receive any wages, employee benefits, or other compensation. The Student further acknowledges and understands that the Careerist and its partner companies will not consider the Student to be an employee during the internship and that the Careerist and its partner companies are not required to hire the Student as an employee or contractor upon completion of the internship. The internship will be performed remotely and students agree to have necessary equipment and stable internet connection.
Internship projects may be subject to eligibility criteria indicated by Careerist Inc.
Please be informed that by joining an internship, you accept full responsibility for the applicable laws, including but not limited to labor and immigration laws and regulations. If it is applicable to your situation, you agree to obtain all necessary visas and permissions and to comply with all applicable regulations to be eligible to get access to the internship. You agree to indemnify, defend and hold Careerist, along with its affiliates, officers, directors, contractors, employees, subsidiaries, educational partners, agents, and permitted assigns, harmless from any liability for, or assessment of, any claims or penalties or interest with respect to such labor or immigration requirements, including any liability for, or assessment of, penalties imposed on Careerist, its affiliates, officers, directors, contractors, employees, subsidiaries, educational partners, agents, and permitted assigns, by the relevant authorities with respect to any violations of labor or immigration laws set forth herein.
FLSA Acknowledgments (Internship Project). Student acknowledges and agrees, in furtherance of the seven-factor analysis set forth in U.S. Department of Labor Fact Sheet #71 and Glatt v. Fox Searchlight Pictures, Inc., 811 F.3d 528 (2d Cir. 2015), that: (a) the internship is structured as an extension of, and is integrated with, Student’s educational program with Careerist; (b) the internship is to be of a fixed and finite duration not exceeding six (6) months; (c) Student understands that Student will not receive any wages, employee benefits, or other compensation for the internship from Careerist or from any partner company, and that the internship is unpaid; (d) the internship work performed by Student complements, and does not displace, paid employees of Careerist or of any partner company, and Student’s contribution is incidental to Student’s training rather than a substitute for the work of an employee; (e) Careerist and the partner company provide training and supervision to Student that is similar in quality to that which would be given in an educational environment; (f) the internship is conducted under the close supervision of existing personnel and provides Student with significant educational benefit; and (g) neither Careerist nor any partner company is required to hire Student as an employee or contractor at the conclusion of the internship, and Student is not entitled to any such offer of employment.
F-1 / J-1 Visa Notice. Students who hold F-1, J-1, or other non-immigrant U.S. visa status should be aware that participation in an unpaid internship in the United States may constitute “employment” under U.S. immigration law (see, e.g., 8 C.F.R. §§ 214.2(f)(10), 214.2(j)(1)) regardless of whether wages are paid, and may require prior Curricular Practical Training (CPT), Optional Practical Training (OPT), or comparable authorization from the Student’s Designated School Official (DSO) or J-1 program sponsor. Careerist is not a Designated School Official and does not provide immigration counsel. Students on F-1, J-1, or other non-immigrant status are strongly encouraged to consult their DSO, program sponsor, or qualified immigration counsel before commencing any internship and to confirm whether the proposed internship can be performed without violating their visa status. Careerist is not responsible for any adverse immigration consequences resulting from Student’s participation in the internship without proper authorization.
By joining the internship program, you agree to sign a non-disclosure agreement (NDA) and/or unpaid internship agreement as may be required by the internship project’s terms and conditions. Please be aware that Careerist reserves the right to cancel the internship program if you refuse to sign the NDA and/or unpaid internship agreement.
2.2. Career coaching services:
2.2.1. Career Coaching services include:
A total of nine (9) coaching sessions;
Recommendations from career coach on how to build a LinkedIn profile and resume;
Recommendations from career coach regarding job search strategies (the geography and number of relevant positions to apply for, and extra information regarding the interview process in tech companies).
Month 1: Foundational Development
Resume-Building Session (1 session, 30 minutes)
LinkedIn Optimization Session (1 session, 30 minutes)
Interview Preparation Sessions (2 sessions, 30 minutes each)
Months 2-4: Strategic Advancement
Job Search Strategy Session (1 session, 30 minutes)
Mock Interviews (2 sessions, 30 minutes each)
Customized Coaching Sessions (2 sessions, 30 minutes each)
All students will receive Continuous Support for a period of six (6) months from the start of Career Coaching, as well as access to bi-weekly group coaching sessions. If students require additional assistance and wish to extend the coaching period, they must contact their Career Coach. All extensions and group coaching activities are subject to coach availability.
At the end of the coaching stage, all students are required to complete a mandatory final (mock) interview with an Interview Specialist.
The Student has up to three (3) attempts to complete the Final (Mock) Interview.
Please be advised that “no show-up”/canceled OR rescheduled less than 24 hours sessions are counted as an attempt. Successful completion of the Final (Mock) Interview is mandatory to receive the final certificate of completion.
2.2.2.The student is entitled to use these services no later than twelve (12) months from the date of purchase. Any extension of this period is subject to availability and at the sole discretion of the company and may require additional fees.
CAREERIST CAREER COACHING SERVICES FOR NON-US STUDENTS ARE LIMITED TO MOCK INTERVIEW SESSIONS AND RECOMMENDATIONS ON BUILDING A LINKEDIN PROFILE AND RESUME. CAREERIST DOES NOT OFFER STUDENTS SERVICES RELATED TO APPLYING FOR WORK OR INTERNSHIP VISAS OR ANY OTHER TYPE OF AUTHORIZATION TO LIVE AND WORK IN THE US. CAREERIST DOES NOT OFFER SERVICES RELATED TO JOB SEARCH MARKET GUIDANCE OUTSIDE THE US.
2.2.3.Each consultation with the career coach is scheduled to last 30 minutes. The consultation will begin at the scheduled time, and it is the responsibility of the participant to join the Google Meet / Zoom session promptly. If you arrive late, the consultation time may be reduced accordingly, as the session will still end at the originally scheduled time.
Advance Notice for Rescheduling or Cancellation:
— If you need to cancel or reschedule your consultation, please notify us at least 24 hours in advance.
— You agree to reschedule sessions to a time slot that is available in the Career Coach calendar;
— You may reschedule sessions only for justified reasons, such as personal and medical emergencies, technical failures or unforeseen circumstances. You will strive to fulfill your commitments. Careerist reserves the right to require reasonable documentation to verify such circumstances;
You must communicate any changes to the session schedule to the Coach in writing via email.
The total price for the Services is as indicated in the payment link, payable through the methods outlined at checkout. By purchasing the Services, the Participant authorizes Careerist Inc. to charge the selected payment method for the total amount indicated.
Installment Payments: If the Services offer payment via installments, the Participant agrees to make all installment payments on time according to the agreed schedule. Failure to complete payment may result in revocation of access to the Services.
Currency: All prices are listed and payable in US dollars.
To request a refund, you must contact us at [email protected] within seven (7) days of Service commencement, providing your reason for the refund request. After this period, all sales are final, and no refunds will be issued. If you are eligible for the refund, it shall be processed within 30 days of the refund request date. For the avoidance of doubt, first communication with an internship coordinator or a career coach means the start of using Service.
Notwithstanding the foregoing, the seven (7)-day deadline above shall not limit any non-waivable cancellation or refund right Student has under applicable law (including any law of Student’s state of residence), and where Student is entitled to a pro-rata refund under the Careerist Refund and Cancellation Policy, as in effect from time to time, those rights shall apply in addition to (and where more favorable to Student, in lieu of) the rights set forth in this Section 4.
All students agree to abide by the Careerist communications policy, which forbids the following:
Harassment or discrimination of any kind, including but not limited to race, gender, age, religion, sexual orientation, or disability;
Offensive or abusive language, personal attacks, or threats towards fellow users, staff, or any individuals;
Posting or sharing of explicit, inappropriate, or offensive content;
Unauthorized sharing of confidential company information;
Spamming or excessive self-promotion;
Violation of any applicable laws or regulations in our communication channels.
We believe adherence to these guidelines will help foster a positive and inclusive learning environment at Careerist.

Be respectful and treat others with respect, kindness, and empathy;
Foster positivity and try to keep discussions positive, encouraging, and supportive;

Embrace different perspectives, respect diverse opinions, and engage in constructive discussions.
Participant Cancellation: You may cancel your participation in the Services at any time; however, no refunds will be provided unless within the terms outlined in the refund policy (section 4 of these Terms) or as required by the Careerist Refund and Cancellation Policy or any non-waivable cancellation or refund right Student has under applicable law.
Termination by Company: We reserve the right to terminate or suspend your access to the Services if you breach these Terms, engage in unlawful behavior, or misuse the Services. In addition, Careerist may suspend Services or immediately terminate them if: (i) you use the services in a way that disrupts or threatens the services or violates the Careerist communication policy; (ii) we determine, in our sole discretion, there is evidence of fraud with respect to your account; (iii) we receive notice or we otherwise determine, in our sole discretion, that you may be using services for any illegal purpose or in a way that violates the law or violates, infringes, or misappropriate the intellectual property rights of any third party. In the event of termination due to a breach of these Terms, no refund will be provided.
To the fullest extent permitted by law, Careerist Inc. will not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or personal injury resulting from your using the Services, even if Careerist Inc. has been advised of the possibility of such damages. Careerist’s aggregate liability for any claims relating to these Terms will be limited to the greater of (a) the total fees paid by you to Careerist for the applicable Service, or (b) US $500.Notwithstanding the foregoing, in no event shall Careerist’s aggregate liability under these Terms be less than US $500. Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, willful misconduct, personal injury or death caused by Careerist’s negligence, or any rights that may not be waived under applicable consumer-protection statutes.
No Guarantees: The Services are intended to provide educational content and tools to support participants’ learning and professional skills. However, Careerist Inc. makes no guarantees of specific outcomes or success as a result of using the Services. Careerist Inc. is not an employment agency, recruiter, or staffing service, and we do not guarantee employment, job placement, or career advancement as a result of participation in our programs. While our internship and coaching Services may provide participants with tools, strategies, and resources to help them pursue job opportunities, all career-related decisions and outcomes are the sole responsibility of the individual participant. Participants acknowledge that success in any endeavor depends on many factors outside the control of the Company, including but not limited to individual qualifications, market conditions, and external circumstances.
Disclaimer of Warranties: The Services are provided on an “as-is” basis. To the maximum extent permitted by law, Careerist Inc. disclaims any and all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Careerist Inc. reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
Notwithstanding the foregoing, Careerist will provide Students with advance notice (by email to the address Student has provided to Careerist or by prominent on-Service notice) of any material changes that adversely affect Student’s rights or obligations under these Terms before such changes take effect. Such material changes will not apply retroactively to claims arising before the effective date of the change. If Student does not agree to the modified Terms, Student may terminate Student’s use of the Service before the effective date of the change and request a refund in accordance with Section 4 of these Terms.
Any claim relating to these Terms or the Services shall be governed by the laws of the State of New York without regard to its conflict of law provisions; provided that any non-waivable consumer-protection rights conferred on Student by the law of Student’s state of residence shall continue to apply.
Before either party may seek arbitration, the party must first send to the other party a written Notice of Dispute describing the nature and basis of the claim or dispute, and the requested relief. A Notice to Careerist should be sent to: [email protected]. After the Notice is received, you and Careerist may attempt to resolve the claim or dispute informally. If you and Careerist do not resolve the claim or dispute within thirty (30) days after the Notice is received, either party may begin an arbitration proceeding. All claims and disputes (excluding claims for injunctive or other equitable relief and the carve-outs set forth below) in connection with these Terms or the use of any product or service provided by Careerist that cannot be resolved informally or in small claims court shall be resolved by binding arbitration on an individual basis under the terms of this Arbitration Agreement. This Arbitration Agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. Arbitration shall be administered by JAMS pursuant to the JAMS Consumer Arbitration Minimum Standards, and where applicable the JAMS Streamlined Arbitration Rules & Procedures for claims under US $25,000 or the JAMS Comprehensive Arbitration Rules & Procedures for claims of US $25,000 or more, all available at www.jamsadr.com. The arbitration shall be conducted by a single, neutral arbitrator. For consumer arbitrations, Student’s share of arbitration filing fees shall not exceed US $250, with all remaining fees and arbitrator compensation paid by Careerist; provided that this fee allocation shall not apply where Student is found by the arbitrator to have brought a claim in bad faith or for an improper purpose. The seat of arbitration shall be New York County, New York, and the parties expressly agree to venue and jurisdiction in the state and federal courts located in New York County, New York for any proceedings ancillary to such arbitration; provided that, where required by applicable consumer-protection law, Student may elect to arbitrate or litigate in the state and federal courts of Student’s state of residence. Nothing in this Arbitration Agreement shall preclude either party from seeking provisional relief from a court of competent jurisdiction in aid of arbitration.
Carve-outs. The following claims shall not be subject to this Arbitration Agreement and may be brought by either party in a court of competent jurisdiction located in New York County, New York: (a) claims for injunctive or other equitable relief to prevent the actual or threatened infringement, misappropriation or violation of a party’s intellectual property, trade secrets, or confidentiality rights; (b) claims for defamation; (c) claims arising under the Computer Fraud and Abuse Act, 18 U.S.C. § 1030; and (d) Careerist’s claims for collection of unpaid amounts due under these Terms.
CLASS ACTION WAIVER. AS PART OF THE FOREGOING ARBITRATION AGREEMENT, STUDENT ACKNOWLEDGES AND AGREES THAT ANY CLAIM STUDENT MAY HAVE AGAINST CAREERIST, INCLUDING CAREERIST’S PAST OR PRESENT EMPLOYEES, CONSULTANTS OR AGENTS, SHALL BE BROUGHT INDIVIDUALLY AND STUDENT SHALL NOT JOIN SUCH CLAIM WITH CLAIMS OF ANY OTHER PERSON OR ENTITY OR BRING, JOIN OR PARTICIPATE IN A CLASS ACTION AGAINST CAREERIST. PARTIES HEREBY KNOWINGLY AND VOLUNTARILY WAIVE THEIR RIGHT TO TRIAL, INCLUDING JURY TRIAL, ON ANY CLAIM IN ANY COURT OF LAW OR EQUITY.
