The Careerist Guarantee

Valid for contracts signed from 11.16.2021 till 07.18.2022

Welcome to the online learning management platform developed by Careerist Inc. (“Careerist”, “we”, and “us”) for students and instructors to communicate and learn in a more efficient way from our educational partners* (the “LMS”). Educational partners and Careerist are committed to your success, and will support you fully in the transition into your tech career. We back our commitment with the following Careerist Guarantee: subject to your full and continued compliance with the Terms below, Careerist will refund 100% of your upfront payment for the Applicable Training Program as defined below if you are not offered a Qualifying Position (as defined in the Terms) within the Guarantee Period of receiving a certificate of completion. If you are paying for your program by entering into the Income Share Agreement (the “ISA” or similar agreement) funded by Careerist, we will refund 100% of the Registration Fee you paid if you do not receive a Qualifying Offer (as defined in the Terms) within the Guarantee Period of receiving a certificate of completion.

Applicable Training Program shall mean Manual QA course, Automation QA course, Technical Sales course, System Engineering course, Tech Career Bundle, Tech Sales Bundle taught by our educational partners through the LMS on or after the date this Guarantee is published on the Careerist’s website. The date of publication is shown on the very last page of this Guarantee and the Guarantee is applicable if there is a link to it in the agreement signed between Careerist and the Student.

A career start or transition in the tech industry involves focused, consistent effort. We put in this effort to help you make that transition, and ask for the same commitment from you. Specifically, you shall satisfy the requirements below in order to be eligible for the Careerist Guarantee. If these requirements are not satisfied, you may still participate in the training program and receive all of the advantages of career support, but you will not be eligible for the Careerist Guarantee. 

Terms

The following terms and conditions (the “Terms”) apply to the Careerist Guarantee:

Eligibility Requirements

  • You must be 21 years or older.
  • You must be eligible to legally work in the United States by the time you complete the training program.
  • You must be eligible to legally work in the United States by the time you complete the training program.
  • You must live in, or within a one (1) hour commute of one of the Metropolitan Areas as defined below.
  • You must be able to pass any background checks associated with jobs that you are going to apply for. Without limiting the foregoing, if you fail to obtain a job offer directly or partially due to your failure to pass a background check associated with the job offer, you will not be eligible for the Careerist Guarantee. 

Application Conduct

Definitions

Job Application Service (JAS) - is a service that will actively look for employment for You in Qualifying Positions. “Qualifying Position” is defined as any role that is or is substantially similar in nature to in the learning area of Manual QA: Software Quality Assurance, Software Development, Information Technology, Software test engineer, QA analyst, QA tester, Manual tester, Functional tester, UI tester, Hardware tester, Black-box tester, Test analyst, Quality engineer (QE); In the learning area of Automation QA:QA Automation Engineer, SDET (Software Engineer in Test), QA Automation Tester, Software Tester; In the learning area of Sales Training & Sales Engineer & Solutions Architect: Sales Associate, Sales Consultant, Sales Development Representative (SDR), Tech-Sales, Inside Sales, Representative, Outside Sales Representative, Account Executive (AE), Account Manager, Sales Manager, Sales Operations Analyst, Sales Support, Client Services, Sales Lead, Lead Generation/Development, Business Development Managers, Technical Sales, Sales Operations Manager, Regional Sales Manager, Director of Sales, Vice President (VP) of Sales, IT Support Representative, Sales Assistant, Sales Operations, Analyst, Sales Engineer, Solutions Engineer, Pre sales Engineer, Post sales Engineer, Systems Engineer, Applications Engineer, Sales Application Engineer, Associate Sales Engineer, Associate Applications Engineer, Associate Solutions Engineer, Associate Systems Engineer, Technical Support, Technical Support Engineer, Technical Sales Engineer, Field Sales Engineer, Software Sales Engineer, Customer Success Manager (CSM), Customer Engagement Manager, Product Manager, Data Analyst, Python Developer, Solutions Architect, Technical Architect, Senior Solution Architect, Associate Solutions Architect, Principal Solutions Architect, Technical Solution Architect, Senior Technical Architect, Presales Solution Architect, Junior Solutions Architect, Partner Solutions Architect, Chief Solutions Architect, Senior Cloud Architect, Senior Enterprise Architect, Analytics Architect, Customer Solutions Architect, Entry Level Solutions Architect, Solution Architect Manage; in the learning area of Systems Engineer: System Administrator, Cloud engineer, Network engineer, Network Administrator, System Operations engineer, IT Operations engineer, IT Support Administrator, IT Specialist, Helpdesk Administrator, IT Support and System Administrator, Network Operation Center (NOC), Storage Administrator, Information Technology, Software Administrator, DevOps, Software Development, Information Technology,  Product Analyst, Data Analyst, Artificial Intelligence Developer, Machine Learning Engineer, Internet-of-Things Developer, Internet-of-Things Engineer, Cloud Engineers; and other similar positions:

  1. A salaried employee or waged employee working an average of at least 30 hours a week onsite or remote; 
  2. A full-time (30 or more hours per week) contractor, intern or other compensated service provider relationship for 3 months or longer working onsite or remote; or 
  3. A paid onsite or remote contractor or intern that has the potential to be extended or converted to a full-time role.

Please note that while the training program offered through the LMS prepares you for a career in a specialized field, we cannot guarantee that your first position will be in that field.

If you are paying for your program using the Income Share Agreement funded by Careerist, a “Qualifying Offer” is defined as an offer for a Qualifying Position that you accepted and started working in this Qualifying Positions. If your Income Share Agreement is managed by a third party provider, we may communicate to your ISA manager that you have received an “Offer of Employment” once you have received a Qualifying Offer.

The “Guarantee Period” is defined as the period beginning at enrollment and ending 12 months after receiving a certificate of completion, or a longer period as set forth below. The Guarantee Period may be terminated or extended unilaterally by Careerist for up to six months if there is a natural disaster, including COVID-19 related reasons and mass vaccination, or extensive lay offs in the tech industry, or other occurrence beyond Careerist’'s control at any point during the Guarantee Period that disrupts the job market nationally.

The “Metropolitan Areas” means the 100 mile radius territory of the following cities: Atlanta, GA; Austin, TX; Boston, MA; Chicago, IL; Dallas, TX; Denver, CO; Los Angeles, CA; New York City, NY; Phoenix, AZ; San Francisco Bay Area, CA; and Washington, DC.

Commitment to the Training Program and Your Own Success 

We require that you fully commit to your job search and take our recommendations seriously. As a graduate of the Careerist training program, we expect you to be an active participant in your own success, and put significant effort into your own growth and your job search. Therefore, for the Careerist Guarantee to be applicable: 

  • You must have completed all the mandatory requirements for successful program completion, including:
  • You must complete 100% of the core curriculum within 2 months of your program start date, not including any freeze, pause, or extension granted to you by Careerist or respective educational partner.
  • You must meet or exceed expectations on all core projects, according to the program curriculum or outline. You are welcome to submit improved versions based on your mentor’s feedback until you meet expectations.  
  • You must have completed and passed all career development tasks that are (a) listed in the curriculum, in the order they appear in the curriculum, and (b) personally assigned to you by your program instructors. This includes without limitation taking all calls and passing mock interviews (failing to pass mock interviews may terminate eligibility for the Careerist Guarantee).
  • Starting on the day you completed the training program and met all the above mandatory requirements: 
  • You must be an active user of Job Application Service during the whole Guarantee Period. Consult Your agreement provisions for more detail about the period of JAS which is included in Your Careerist agreement; JAS service may be subject to additional payments depending on the provisions of the agreement signed between You and Careerist.
  • You must be active in your job search and apply for a minimum of 4 Qualifying Positions in the Metropolitan Areas per week, in accordance with best practices recommended by Careerist career mentors. Notwithstanding the foregoing sentence, remote work is also acceptable provided that all other criteria are met. 
  • You must be active in building your network and reach out to at least 7 individuals per week and conduct 2 informational interviews per month. Outreach includes emailing, LinkedIn messages, meetups and conferences. An informational interview may be done in person, video chat or phone call. Being consistent in your networking including making contacts and following up is critical to one’s success in the job search. 
  • You must schedule calls with a Careerist career mentor at the frequency instructed by the coach, subject to the coach’s availability.
  • You should take guidance from your Careerist career mentors team, and follow their recommendations on your job search strategy including building your network and applying for Qualifying Positions that are a good fit for you. You should be applying for roles that are suited to your level of experience and areas of expertise, and maintain realistic expectations about what kind of first job in data science is right for you.
  • You must provide the Careerist career mentors team with a weekly summary of job-related activity through the LMS or any other way advised by Careerist, including all job applications submitted and networking efforts made. You agree to provide the Careerist career mentors team with further job-related information upon our request.
  • You must respond to placement related communications from Careerist within 24 hours.
  • You must always act with reasonable and good faith efforts to obtain a Qualifying Position.

How This Guarantee Applies To You

Without limiting the foregoing, situations that void this Careerist Guarantee and make it null include, but are not limited to (at Careerist’s sole discretion): 

  1. You turn down a job offer for a Qualifying Position. 
  2. You decide not to conduct a job search for all or part of the Guarantee Period and/or you decide not to renew your subscription to the Job Application Service before the Guarantee Period expires, provided that you may elect to suspend your job search for up to six months upon written notice to Careerist, and such written notice shall constitute a mutual agreement to extend the Guarantee Period, and provided further, that Careerist may extend the Guarantee Period by up to six months following your resumption of your job search. Any offer for a Qualifying Position received during a suspension shall still terminate eligibility for a refund.
  3. You decide to search for a role that does not meet the Qualifying Position criteria above, or is outside of the tech industry. 
  4. You accept a role that does not meet the Qualifying Position criteria above, or is outside of the tech industry, before the Guarantee Period is over.
  5. You do not put sufficient and consistent effort into your job search, as outlined above. 
  6. You do not want to or are unable to live and work in the United States. 
  7. You do not communicate with the Careerist career mentors team consistently throughout your search, including notifying us of any offers you have received.  
  8. You lose your work authorization or do not have sufficient work authorization that meets the requirements above during your search, even if you did expect to have authorization or did at one time have appropriate work authorization during your training program.
  9. You become physically or mentally unable to conduct an effective job search as outlined above during the training program or Guarantee Period.
  10. You do not apply for Qualifying Positions in the Metropolitan Areas as required above throughout the Guarantee Period. 
  11. You significantly change your job search strategy during the Guarantee Period without obtaining prior written consent from the Careerist career mentors team. 
  12. You do not follow through with the interview process for Qualifying Positions in a timely and professional manner, including but not limited to not participating as expected by the employer in the interview process by providing responses to employer communications, showing up on time for interviews, and providing documents or follow up as expected by employers.
  13. You do not apply for jobs that are suitable for your background or experience as discussed in your calls with the Careerist career mentors team. 
  14. You no-show or reschedule/cancel a call with less than 24 hours notice with a career coach or mock interviewer 3 or more times. 
  15. You choose to start your own business or to work as a freelancer.

Certification for Reimbursement

If you believe you qualify for a reimbursement, you must provide a written and signed certification that you have met all the requirements set forth in these Terms, and have not been offered any Qualifying Positions, at [email protected] within one calendar month following the expiration date of the Guarantee Period.

General

This Careerist Guarantee and Terms, along with the Careerist’s Privacy Policy, Terms of Service and Refund & Cancellation Policy, set forth the entire understanding between you and Careerist with regard to your eligibility for the Careerist Guarantee. Any provision of these Terms that is unenforceable shall not impact the enforceability of any other provision. Careerist shall have the sole discretion to determine whether the Terms have been satisfied and whether you are eligible for a refund of your upfront payment or registration fee if you entered into the ISA. Likewise, Careerist may waive any breaches in its sole discretion.
